MARQUARDT, J.:

The State of Kansas appeals the trial court's dismissal of charges against Scott Haney on the ground that his right to a speedy trial was violated. We affirm.

The facts of this case are not disputed. On January 3, 2003, Haney was charged with one count of misdemeanor sexual battery. In October 2003, Haney filed a motion to dismiss, claiming the case was not timely prosecuted. The trial court granted the motion, finding that Haney was not brought...
