Petitioner Pellegrino DiCianni (hereinafter petitioner), a maintenance worker at respondent Hudson Valley Community College, was issued disciplinary charges for allegedly sleeping on the job.* Following a hearing, DiCianni was found guilty of failing to perform assigned job functions during assigned work hours.
