The defendant Konecranes, Inc. submits a motion seeking an order for summary judgment dismissing the complaint of the plaintiff Kevin Buja.

By stipulation of discontinuance filed in the Monroe County Clerk's office on November 8, 2004 the parties discontinued the action as against KCI Konecranes International plc.
