On September 11, 2003, a Federal Grand Jury indicted Noah Moore on a single count of conspiring to distribute more than 100 grams of heroin. Moore was then serving a sentence for a 1993 federal narcotics conviction.

On January 29, 2004, Moore moved to suppress recordings of his telephone conversations, which had been monitored and recorded by the Bureau of Prisons during his imprisonment and which the government intended to introduce...
