Following a jury trial, Charles Paine, Jr. and Lynne Paine appeal a judgment in favor of Gregory Nations in his suit against them for trespass involving an easement Nations held over land owned by the Paines. Specifically, the Paines contend that (1) the trial court erred by not bifurcating the trial to first determine the existence of the easement, and (2) the evidence did not support a finding of liability or an award of punitive damages...
