On December 14, 2005, the Court heard oral argument on the application for leave to appeal the August 31, 2004 judgment of the Court of Appeals. On order of the Court, the application is again considered. MCR 7.302(G)(1). In lieu of granting leave to appeal, we REVERSE Part III of the Court of Appeals opinion and REINSTATE the Oakland Circuit Court's order denying plaintiff's motion for reconsideration.
