Following a jury trial, defendant was convicted of two counts of promoting prison contraband in the first degree and attempted escape in the first degree. Thereafter, County Court partially granted defendant's motion to set aside the verdict pursuant to CPL 330.30 by setting aside the guilty verdict on the attempted escape in the first degree count. Defendant was sentenced as a second felony offender to two concurrent prison terms of 2½ to 5 years...
