The state appeals an order dismissing a complaint charging defendant with driving under the influence of intoxicants (DUII), ORS 813.010, after the court determined that defendant had satisfied the terms of a diversion agreement. The state argues that the trial court erred in dismissing the complaint because defendant did not complete the terms of the diversion agreement within the time allowed by law.
