OPINION OF THE COURT

L. PRISCILLA HALL, J.

The defendant, pro se, moves for an order resentencing him pursuant to chapter 643 of the Laws of 2005, made retroactive as of October 29, 2005 to all incarcerated prisoners who were convicted of a class A-II drug felony.

In deciding this motion, the court has considered the motion papers, the affirmation in opposition and the court file.
