A jury found appellant Harold Miller guilty of capital murder in the course of committing or attempting to commit robbery. See Tex. Pen.Code Ann. § 19.03(a)(2) (West Supp.2005). The State did not seek the death penalty, and the district court assessed punishment at life imprisonment.
