Pursuant to Texas Rule of Appellate Procedure 50, we have reconsidered our previous opinion on the filing of appellant's petition for discretionary review, which was filed in this Court on November 30, 2006. See TEX.R.APP. P. 50. We withdraw our opinion and judgment dated November 2, 2006 and substitute the following opinion and judgment in their place. See id.
