D'Ambrosio (D'Ambrosio, Mr. D'Ambrosio, Robert, or Petitioner) appeals from the findings of fact, conclusions of law, and order entered by the Circuit Court of the First Circuit (the circuit court)1 on June 13, 2003 (the June 13, 2003 order), summarily dismissing his Hawai`i Rules of Penal Procedure (HRPP) Rule 402
