GUSTIN L. REICHBACH, J.

The defendant was convicted, after a jury trial, of murder in the second degree (Penal Law § 125.25 [2]) and sentenced on May 7, 2001 to a term of 17½ years' imprisonment. The defendant appealed his conviction and argued that the People had failed to disprove his justification defense beyond a reasonable doubt and that the hearing court had abused its discretion in reopening the suppression hearing....
