I. INTRODUCTION

Plaintiff Mritunjoy Sengupta was terminated for cause by the University of Alaska Fairbanks in 1995. In 2002 he unsuccessfully sought reemployment with the university. Sengupta then sued the university and related parties (collectively the university or UAF) for refusing to rehire him.
