In satisfaction of a two-count indictment, defendant pleaded guilty to criminal sale of a controlled substance in the second degree. Although the negotiated plea agreement called for a sentence of 7½ years to life in prison, County Court ultimately imposed an enhanced sentence of 10 years to life based upon defendant's purported failure to cooperate at the sentencing hearing by refusing to admit second felony offender status.
