Before the Court is a motion by Plaintiffs Republic of Ecuador and Petroecuador (collectively "Ecuador") to dismiss the counterclaim by Defendants Chevron Texaco and Texaco Petroleum Company (collectively "TexPet") for failing to state a claim. This counterclaim asserts that an action brought by private plaintiffs in Ecuador ("the Lago Agrio action") is barred under the terms of contractual releases from 1995 and 1998...
