{¶ 1} Relator-appellant and cross-appellee, Shihab & Associates Co., L.P.A., appeals from a judgment of the Franklin County Court of Common Pleas adopting a magistrate's decision that (1) awarded attorney fees to respondent-appellee and cross-appellant, Ohio Department of Transportation ("ODOT"), arising from relator's allegedly frivolous conduct, and (2) denied relator's cross-motion
