Opinion by SANDEE BRYAN MARION, Justice.

This is an interlocutory appeal from an order granting a partial summary judgment in favor of appellee, Canyon Regional Water Authority ("CRWA"). See TEX. CIV. PRAC. & REM.CODE ANN. § 51.014(d) (Vernon Supp.2005). We conclude the trial court erred in rendering judgment in CRWA's favor and erred in denying summary judgment in favor of appellant, Guadalupe-Blanco
