The Court has before it the Defendants' motion to dismiss the remaining counts of the Plaintiff's second amended complaint and the Plaintiffs objection thereto and the Plaintiffs motion to amend the complaint and the Defendants' objection thereto. The Court has heard the arguments of counsel on both matters and has taken them under advisement.
