In 1993, following approval by the Falmouth planning board of a subdivision plan of defendant Robert S. Hurd, contingent on the applicant's right to pass over Gerloff Road, a judge of the Land Court determined that Hurd had no right to extend Gerloff Road southerly for access to the subdivided lots...
