THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. JAVIER RAMIREZ, Appellant.

Appellate Division of the Supreme Court of the State of New York, First Department.

Decided October 19, 2006.

The verdict was based on legally sufficient evidence and was not against the weight of the evidence (see People v Bleakley, 69 N.Y.2d 490 [1987]). While each link in the chain of circumstances might have an innocent explanation when viewed in isolation, the evidence, viewed as a whole, supported the conclusion that defendant was a participant in the drug conspiracy.
