This matter is before the Court on the defendants' motion to dismiss for lack of subject matter jurisdiction pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure. Defendants argue that plaintiff's claims do not present a justiciable case or controversy because (1) the plaintiff's claims are not ripe for decision, and (2) plaintiff does not meet the requirements of Article III standing...
