The opinion of the court was delivered by NUSS, J.:

Daryl A. Bischoff was convicted by a jury of one count each of aggravated assault and criminal threat. The Court of Appeals affirmed the criminal threat conviction, but reversed and remanded the aggravated assault conviction on several grounds. We granted the State's petition for review; our jurisdiction is pursuant to K.S.A. 60-2101(b).
