Plaintiffs filed a petition seeking damages against the Defendant for the wrongful death of their decedent due to Defendant's alleged medical malpractice. Defendant raised, among other things, the affirmative defense that the Kansas statute of limitation, the application of which is required by the Missouri borrowing statute, barred Plaintiffs' claim. The trial court sustained Defendant's motion for summary judgment and entered judgment accordingly...
