THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. FRANK BARNES, Appellant.

Appellate Division of the Supreme Court of the State of New York, First Department.

May 16, 2006.

The verdict was not against the weight of the evidence. There is no basis for disturbing the jury's determinations concerning credibility (see People v Gaimari, 176 N.Y. 84, 94 [1903]). Defendant was connected to the crime by two independent witnesses.

There was no violation of Brady v Maryland (373 U.S. 83 [1963]) with regard to a knife that was recovered in a window box of the building where the victim was fatally stabbed...
