PEOPLE v. JOHNSON

28 A.D.3d 359 (2006)

812 N.Y.S.2d 356

THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. KEITH JOHNSON, Appellant.

Appellate Division of the Supreme Court of the State of New York, First Department.

April 20, 2006.

The sentencing court properly denied defendant's motion to withdraw his plea of guilty (see People v. Frederick, 45 N.Y.2d 520 [1978]). Defendant received a reasonable opportunity to advance his claims, and the record shows that defendant's plea was knowing, intelligent, and voluntary, and that counsel provided effective assistance (see People v. Ford, 86 N.Y.2d 397, 404 [1995]).
