Appellant pleaded not guilty to the offense of burglary of a habitation and was convicted by a jury of the lesser included offense of aggravated assault. In response to a special issue, the jury found appellant used a deadly weapon in committing the aggravated assault. The trial court assessed punishment at twenty-two years' incarceration.
