The State of Missouri appeals from the trial court's judgment and order expunging the record of Respondent Lawrence Maserang's arrest on June 17, 1998. The State contends that the trial court failed to follow the statutory conditions for expungement contained in § 610.122,1 in that as a "matter of law there exists probable cause to believe that [Maserang] committed the crimes."
