Per Curiam.

{¶ 1} On an evening in May 2001, defendant-appellant, Garey1 Smith, shot and seriously injured Jeff King ("Dingo") on East 12th Street in the Pendleton area of Cincinnati's Over-the-Rhine district. Moments later, around the corner at Pendleton and East 13th Streets, Smith killed Jimmy Gordon and shot and seriously injured Andre Ridley and Steven "Bill" Franklin.
