On December 10, 2003, the State filed a bill of information charging Jacquelyn Lemon and Frank Rivers, the appellee herein, with one count each of possession of heroin, a violation of La. R.S. 40:966. The bill was docketed under case number 444-022. The defendants were arraigned and entered not guilty pleas on December 23, 2003.
