This is the second time this case has been brought to us for review by the appellant, Sandra Lemay, as Personal Representative of the Estate of Roy Ault, her deceased son. Initially, Ms. Lemay appealed the dismissal of her wrongful death complaint against the defendant, Michael Kondrk, a Putnam County Deputy Sheriff. We concluded that the complaint, as amended, contained sufficient allegations to state a claim meeting the threshold for personal liability...
