In 1999 Harold Johnson was terminated from his position with the District of Columbia Public Schools ("DCPS"). He appealed to the Office of Employee Appeals ("OEA"), asserting that, as a member of the Educational Service, he could not be terminated lawfully without cause. The OEA dismissed his appeal for lack of jurisdiction, finding that he had failed to prove that he was an Educational Service...
