In the present case, the plaintiff, Allstate Insurance Company (Allstate), seeks a declaration that it owes no duty to defend or indemnify the named defendant, Patricia R. Devin, in an underlying action brought against her by codefendant Kelly D. Devin for an alleged assault and battery on January 29, 2005. The plaintiff filed a complaint against both Patricia R. Devin and Kelly D. Devin on October 4, 2005 alleging the following facts in its complaint....
