Monmouth County Indictment No. 01-06-1164 charged defendant, Brendan O'Carroll, with one count of first-degree murder, N.J.S.A. 2C:11-3, in the death of Theresa Nieves. After a Miranda1 hearing, the trial judge denied defendant's motion to suppress statements he made while in custody.
