Defendant, Terry Lathers, was charged by grand jury indictment with one count of second degree murder, a violation of LSA-R.S. 14:30.1. Defendant's brother, Johnny Lathers, was charged by separate indictment with one count of second degree murder arising from the same incident as the charge against defendant.
