Plaintiff Liberty Northwest Insurance Corporation (Liberty) brought a subrogation claim against an insurer that had covered tortfeasors who had caused injuries to one of Liberty's insureds. The insurer became insolvent. Liberty then submitted its subrogation claim to defendant Oregon Insurance Guaranty Association (OIGA). OIGA, however, refused to pay, invoking Oregon statutes that provide that OIGA is not obligated to pay subrogation claims. Liberty...
