OPINION BY FORD ELLIOTT, P.J.:

¶ 1 Dale Edward Hart appeals from the order entered November 23, 2005, denying his first petition filed pursuant to the Post Conviction Relief Act ("PCRA"), 42 Pa. C.S.A. §§ 9541-9546, on the basis that appellant was ineligible for relief because he had served his sentence. We affirm.
