Earline York appeals the dismissal of her challenge to the will of her aunt, Juliette Bijou Polk, on summary judgment. Zerita Polk Depass, Mrs. Polk's sole legatee in the will, has answered the appeal, seeking damages for frivolous appeal and attorney fees for Ms. York's failure to respond to discovery.
