FAY, Circuit Judge:

Javier Mauricio Martinez Ruiz ("Ruiz"), a Colombian citizen, appeals the Board of Immigration Appeals' ("BIA") denial of his application for asylum as well as his request for withholding of removal. Because Ruiz filed his application for asylum 21 days after the one-year deadline, we hold that this Court does not have jurisdiction to review the denial of his asylum application pursuant to 8 U.S.C. § 1158(a)(3).
