On September 1, 2004, the State charged the appellant Leo Batiste with the manslaughter of Alfred Smith. At his arraignment on September 7, 2004, he pled not guilty. The court heard and denied his motions to suppress the evidence and statement on November 3, 2004. On January 5, 2005, a twelve-person jury found Batiste guilty as charged.
