The Louisiana Supreme Court remanded this matter to us for reconsideration in light of Cheron v. LCS Correctional Services, Inc., 04-0703 (La.1/19/05), 891 So.2d 1250. At issue is the application of the automatic stay provision of the Prison Litigation Reform Act ("PLRA") enacted by Act 89 of 2002 to Rhone's civil suit for damages. For the reasons that follow, we find there was no improper retroactive application...
