In this workers' compensation case, the Workers' Compensation Judge (WCJ) ruled that: (1) Claimant's surgical recommendation was reasonable and necessary; (2) Claimant was totally and permanently disabled; and (3) the language in a previously filed joint petition to settle back-due benefits constituted a judicial confession of Claimant's average weekly wage.
