A grand jury indicted Defendant Travis Denny on possession with intent to distribute 500 grams or more of a substance containing cocaine in violation of 21 U.S.C. § 841(a)(1) and (b)(1)(B). Defendant filed a motion to suppress the cocaine which a federal agent seized from his Amtrak train economy sleeper. The district court granted Defendant's motion and the Government appeals.
