DAVIS, Judge.

Russell Insko appeals his judgment and sentence for lewd or lascivious conduct. We affirm.

Insko was tried by jury on the charge of lewd or lascivious conduct by a person over eighteen on a person under sixteen pursuant to section 800.04(6)(a)(2) and (b), Florida Statutes (2001). The jury returned a verdict of guilty but also found Insko to be under eighteen years of age.1
