STATE v. SHELL

No. 2D05-2709.

932 So.2d 628 (2006)

STATE of Florida, Appellant, v. Angel Diane SHELL, Appellee.

District Court of Appeal of Florida, Second District.

July 7, 2006.

Attorney(s) appearing for the Case

Charles J. Crist, Jr., Attorney General, Tallahassee, and Susan D. Dunlevy, Assistant Attorney General, Tampa, for Appellant.

James Marion Moorman, Public Defender, and Cynthia J. Dodge, Assistant Public Defender, Bartow, for Appellee.

WALLACE, Judge.

The State appeals the trial court's order granting Angel Diane Shell's motion to suppress statements she made to a law enforcement officer without the benefit of the Miranda1 warning. Because we find that Ms. Shell was not in custody when she made the statements, we reverse the order and remand for further proceedings.
