MEMORANDUM OPINION AND ORDER

MORAN, Senior District Judge.

Secretary of Labor Elaine Chao brought this action against defendants Michael Linder, Joseph/Anthony & Associates, Inc. ("JAA"), Liz/Mar and Associates, Inc. ("Liz/Mar"), and various other pension and health and welfare plans, and their trustees, for violations of the Employee Retirement Income Security Act of 1974 ("ERISA"), 29 U.S.C. § 1001 et seq.1
