This is a criminal case in which defendant challenges the sufficiency of the evidence to support his conviction for the offense of kidnapping in the second degree (ORS 163.225, set out post). The Court of Appeals affirmed the conviction, although it remanded defendant's case to the trial court for resentencing. State v. Murray, 200 Or.App. 732,
