Jeffrey Stevens was a passenger in a vehicle when the driver was lawfully stopped by Terre Haute, Indiana, police for disregarding a traffic light. Upon approaching the vehicle, two officers saw a pistol-grip shotgun between Stevens's legs, the grip resting in his lap. A pistol was subsequently found directly underneath Stevens's seat.
