On September 24, 2004, plaintiff James Brassell was arrested by Hinds County Deputy Sheriff Robert Turner, Jr. on a misdemeanor charge of willfully evading service of process. Brassell was tried in Justice Court on October 5, 2005, and found not guilty based on the judge's determination that the document which Turner had sought to serve on Brassell was not "process."
