The plaintiff-appellant, Ralph Slaughter, Secretary of the Department of Revenue and Taxation, State of Louisiana (hereinafter referred to as "the State"), appeals a judgment in favor of the defendant-appellee, ARCO Chemical Company1, dismissing the State's claim for attorney's fees on the grounds of abandonment for three years non-prosecution.
